A registered design can be a valuable commercial asset, which grants you the exclusive right to use, make and sell products having your design. A design is the overall visual appearance of a product, which includes the shape of the product or patterns on the product. It does not include the feel of the product, what it is made from or the way in which it works.

To be registrable, a design must be both new and distinctive. For a design to be considered ‘new’, an identical or very similar design must not have been publicly used in Australia and must not have been published in a document anywhere in the world. Therefore, it is important that you apply for design protection before you publicly disclose your design.
